"We will not use Your Inputs, Data, Outputs, and Suggestions to train any language models ... unless You expressly agree to it", and JetBrains undertakes that all AI subcontractors commit not to train on them either, at least to the same extent. Opting in to data sharing is what allows training of JetBrains-owned models such as Mellum. No retention window is published.

JetBrains is explicit that AI features send inputs onward: "IF YOU USE JETBRAINS AI, WE WILL SEND YOUR INSTRUCTIONS AND SOME OTHER INFORMATION TO THIRD PARTIES PROVIDING LARGE LANGUAGE MODELS". JetBrains is the processor and the model operators are sub-processors.

The most instructive row in this batch, because it separates establishment from data path. JetBrains s.r.o. is a Czech company, says so on its own privacy pages, and is directly regulated by the GDPR — and it discloses its AI sub-processors better than almost anyone here, with a named table and data-centre locations. Read that table and five of the six model operators are US-only: OpenAI, Anthropic, xAI, Baseten and Tavily, with Google the only one listing an EU location. No EU-residency option for AI Assistant inference is published anywhere. The contractual protections are real and unusually strong — a written undertaking not to train on inputs, extended by contract to every AI subcontractor, plus SOC 2 Type 2 and a published DPA — but they are protections against use, not against jurisdiction. A European buyer choosing JetBrains AI on the assumption that a European IDE vendor keeps European code in Europe is making an assumption the vendor never made.
